Social Work Success Circle

1. Program Structure

The LSW/LCSW Success Circle is a structured professional exam preparation program offered by James P Nelson Behavioral Healthcare, LLC and delivered by its designated facilitator(s). This program is educational and professional development in nature. It does not constitute therapy, clinical supervision, legal advice, psychological services, or representation before the New Jersey Board of Social Work Examiners. Participation does not create a therapeutic, supervisory, employment, or partnership relationship.

The Success Circle includes:

• Six (6) consecutive instructional weeks
• Weekly 90-minute live sessions
• NJ-specific exam structure education
• FIRST / NEXT / BEST exam strategy training
• Clinical reasoning and vignette analysis
• Practice question breakdown methodology
• Time management and pacing strategies
• Test anxiety regulation techniques
• Structured accountability framework

Cohort size is intentionally limited to preserve engagement and instructional quality.

2. Confirmed Enrollment

Enrollment in the LSW/LCSW Success Circle is considered confirmed when:

1. Participant submits required registration information, and
2. Full payment is successfully processed by the Agency.

Upon confirmation, Participant’s seat in the designated cohort is reserved. Confirmed enrollment constitutes acceptance of all terms and conditions contained in this Agreement and creates a binding contractual obligation between Participant and James P Nelson Behavioral Healthcare, LLC. Reserved seats are limited and held exclusively for confirmed participants.

3. Enrollment Commitment

By confirming enrollment, Participant agrees to:

• Attend scheduled sessions
• Engage actively in instruction
• Complete assigned preparation work
• Adhere to program standards

The Agency reserves the right to assign any qualified facilitator to conduct sessions.

4. Strict Nonrefundable & Nontransferable Policy

All payments made to James P Nelson Behavioral Healthcare, LLC are:

• Final
• Nonrefundable
• Nontransferable

No refunds, credits, deferrals, or transfers will be issued for any reason, including but not limited to:

• Withdrawal from the program
• Missed sessions
• Scheduling conflicts
• Dissatisfaction with program format or delivery
• Failure to sit for the examination
• Failure to pass the examination
• Personal, financial, or professional changes

Participant acknowledges that payment secures a limited seat and compensates the Agency for reserved capacity, preparation, and administrative costs.

5. No Guarantee of Results

The Agency and its facilitator(s):

• Are not affiliated with the New Jersey Board of Social Work Examiners
• Do not control examination scoring
• Do not influence licensure decisions

Participant understands that examination outcomes depend on individual preparation, comprehension, decision-making, and performance.

No guarantee of exam passage or licensure is made or implied.

6. Professional Conduct & Removal

Participants must maintain:

• Professional behavior
• Respectful communication
• Confidentiality
• Ethical conduct

The Agency reserves the right to remove any Participant without refund for:

• Disruptive behavior
• Harassment or discrimination
• Breach of confidentiality
• Unauthorized recording or distribution of materials
• Misrepresentation of program affiliation

Removal does not entitle Participant to any refund or credit.

7. Confidentiality

Participants agree to maintain strict confidentiality regarding:

• Personal disclosures shared within sessions
• Professional experiences discussed
• Study struggles or exam performance
• Any identifying information about other participants

The Success Circle is a professional development environment, not a therapeutic space.

8. Intellectual Property & Protection

All materials provided in the Success Circle; including but not limited to:

• Slides
• Frameworks
• Study guides
• Question breakdown methodologies
• Recordings (if applicable)
• Proprietary exam strategies

are the exclusive intellectual property of James P Nelson Behavioral Healthcare, LLC.

Participants may not:

• Record sessions without written authorization
• Copy, reproduce, distribute, or share materials
• Teach or commercialize program strategies
• Replicate materials for independent business use

Unauthorized use may result in legal action.

9. Limitation of Liability

Participant agrees to release and hold harmless James P Nelson Behavioral Healthcare, LLC, its facilitator(s), officers, contractors, employees, and representatives from any and all claims arising from:

• Examination results
• Licensure outcomes
• Professional consequences
• Financial loss
• Emotional stress associated with testing

Participant assumes full responsibility for exam preparation and performance.

10. Indemnification

Participant agrees to indemnify, defend, and hold harmless the Agency against any claims, damages, liabilities, or expenses arising from:

• Misuse of materials
• Breach of this Agreement
• Unauthorized distribution of intellectual property

11. Dispute Resolution

In the event of a dispute:

1. Parties agree to attempt good faith resolution.
2. If unresolved, disputes shall be submitted to binding arbitration in the State of New Jersey.

Participant waives the right to pursue claims in court except as required by law.

12. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of New Jersey.

13. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, representations, or agreements.

No modification shall be valid unless made in writing and signed by both parties.
